In this clear and insightful video, William Kirk—President of Washington Gun Law and a respected voice in Second Amendment education—breaks down a significant new federal lawsuit challenging Illinois’ longstanding Firearm Owner’s Identification (FOID) Card requirement. As Executive Director of Guns Save Life, I hold William Kirk in high regard; he is not a YouTube nobody offering bad analysis. Kirk is good people who knows his stuff deeply, delivering reliable, constitutionally grounded explanations that gun owners can trust.

Kirk highlights the FOID system, enacted in 1968, as one of the most egregious examples of pre-purchase licensing schemes that convert a constitutional right into a government-granted privilege. Illinois residents must apply, pay fees, submit to background checks, and receive state approval before lawfully possessing firearms or even ammunition. He argues this framework is fundamentally at odds with the Second Amendment’s protection of the right to keep and bear arms, especially for self-defense in the home.

The case, Laurent v. Kelly, filed in the U.S. District Court for the Northern District of Illinois, attacks the FOID Act on two strong fronts: Second Amendment infringement and Fourteenth Amendment due process violations. Plaintiffs include individuals who refuse to obtain a FOID card (and are thus barred from exercising their rights) and one who holds a card but objects to the ongoing requirement. The complaint emphasizes that the state deprives people of a fundamental liberty interest without pre-deprivation due process—shifting the burden to citizens to prove eligibility after the fact, often requiring them to “disprove a negative.”

Kirk notes potential state counterarguments (e.g., standing issues) but praises the complaint’s quality and the experienced counsel involved. He stresses that pre-purchase licensing is uniquely dangerous because it allows government to arbitrarily control who may exercise a right, setting a precedent that threatens gun owners nationwide. The plaintiffs seek a permanent injunction to invalidate the FOID Act entirely.

Overall, Kirk urges viewers—especially Illinois residents—to educate themselves, read the complaint, and stay informed. This video is classic Kirk: straightforward, educational, and optimistic yet realistic about the uphill battle in Illinois courts. It’s essential viewing for anyone concerned about licensing schemes eroding constitutional rights.

Link to complaint in video description for full details. Highly recommended—Kirk delivers the facts gun owners need.

Kirk is mildly “concerned” about filing this in federal court.  But here’s the thing:  Filing it in state court would be a waste of time as the Illinois Supreme Court will NEVER rule against the FOID Act.
