Illinois: New Legislation Seeks to Use a Secret Government List to Strip Your Second Amendment Rights Without Due Process!

Recently, House Bill 4359 was introduced by state Representative Greg Harris (D-13).  HB 4359 will call for the revocation of a citizen?s FOID card and the seizure of his or her firearms if that person?s name is added to the deeply flawed FBI Terror Watch List.  Without due process, this revocation and seizure is a direct violation of your Second Amendment rights and goes against what the American Justice system stands for.  A constitutionally protected right cannot and should not be taken away on the basis of a secretive or unsubstantiated accusation.  In all cases, a judge should be allowed to consider evidence that may support the innocence of the accused.

The NRA does not want terrorists or other dangerous people to have firearms and any suggestion to the contrary is offensive and wrong.  However, if enacted into law, this legislation would result in Americans being denied fundamental, constitutional rights without due process.  NRA is strongly opposed to the idea of a secret government list being used to strip law-abiding individuals of their constitutional rights without due process.

This terror watch list has proved to be flawed, inaccurate, and includes some who have not been vetted by anyone or any organization to be a terrorist or person of interest.  In the past, U.S. Legislators, children and even the Ford Motor Company have been placed on this list.  It is not uncommon for individuals, like Congressman Tom McClintock (R-CA) and the late Senator Ted Kennedy, to mistakenly end up on the No-Fly list.  When Congressman McClintock asked how he could get off of the list, the response was, ?you can?t.?

House Bill 4359 is an egregious violation of your Second Amendment rights.  The NRA needs your help!  Call your Representative and strongly urge him or her to OPPOSE House Bill 4359, legislation that would attack your Second Amendment rights and remove them without due process.

  1. Can we oppose this on-line with witness slips? I couldn’t find a way.

Oh, and in their “honesty”, they named the bill with the short description “POLICE TRAINING;FOID CARD REV”.

  2. I need some help… I just sent an E-mail to my Representative. I also want to send the same E-mail to the 17 representatives who support the bill. The only one out of the 17 who does not list an E-mail address is Greg Harris. Does anyone have a valid E-mail for him? Thanks.

  3. BTW, this is what I sent… Any thoughts or comments?

    Representative ____________:

I am writing to you in opposition to HB4359.

This Bill in Unconstitutional as it proposes to take Constitutional Rights away from United States Citizens because their name has been placed on a list with no evidence being brought against them and with no right to a trial or hearing.

This Bill violates the Second(Right to keep and bear arms), Fourth(Right to protection from unreasonable search and seizure), and Fifth and Fourteenth(Right to due process) Amendments to The Constitution Of The United States Of America.

Any elected official who supports this Bill, would be violating their Oath to support and defend The Constitution Of The United States Of America.

I’m sure you would agree, any elected official who finds themselves unable, or unwilling, to follow their Oath to The Constitution Of The United States Of America, should be considered ineligible to hold that elected position and must step down immediately!

    Thank You,

  4. Just sent a note to my rep. Lou Lang for him to
explain the thought process that went into this.

  6. We should support this bill if, and only if, there is an amendment that provides that, if any state legislator is found to be on the no-fly list, then he or she shall be immediately stripped of his/her position as a democrat legislator and forcibly removed from the state offices without a hearing or other due process. I dont believe those folks in Springfield would vote for such a bill but it illustrates the injustice of their bill. And what is more dangerous than an out of control democrat legislator?

  7. Confiscation should be the line in the sand. If you’re not willing to stand with your friend, neighbor, family member to physically stop this the you don’t deserve to own anything! If it upsets you what I’m saying too bad! The Second Amendment was created to resist tyranny! Not for just hunting, not for marksmanship sports. If you don’t stand up PHYSICALLY then you will reap the totalitarian jackbootery that will follow. Just ask the German Jews circa 1940s how that worked out
